1、“意志论”还是“被决定论”?
———对马克思主义创始人关于法的核心观点的重新解读

【摘要】“法的统治阶级意志论”从实践上看不利于当代中国法治建设,从文字上看不符合马克思主义创始人在《共产党宣言》中论述之原意,从理论上看不符合历史唯物主义思维逻辑。要坚持马克思主义理论对当代中国法学理论研究的指导,需要在“被决定论”的意义上重新理解、阐释马克思主义创始人关于法的核心观点。这对保证当代中国立法、政策、政令符合市场经济关系内涵规则要求、保障社会生产力正常发展具有重要理论指导意义。

2、统治阶级意志还是社会关系?
———苏联建国初期法学界关于法律本质的争论

【摘要】马克思、恩格斯主张的是法律的社会关系本体论。法律的社会关系本体论为列宁、斯图契卡和帕舒卡尼斯所继承和发扬。法律的统治阶级意志论是苏联法学家维辛斯基对马克思主义法律本质理论的错误解读。新中国成立初期,我国法学界接受了经由维辛斯基解读的马克思主义法律本质观,于是法律是统治阶级意志论一直在我国法学界占据支配地位。法律的统治阶级意志论不利于法治中国建设,我们应该坚持和发展法律的社会关系本体论。

3、斯图契卡法学与政治学说的形成与基本观点

【摘要】苏维埃政权早期,法学家在国家和社会的历史抉择中起到了重要的作用,其中以彼得·伊万诺维奇·斯图契卡作为杰出代表。斯图契卡认为,马克思列宁主义对法的解读的理论基础在于:第一,所有的法都有其阶级特征;第二,应当广泛运用革命的辩证法作为方法论;第三,物质社会的关系是解释和解读作为上层建筑的法学思想的基础。斯图契卡的法学与政治学说的发展经历了 1884—1888 年的形成阶段、1888—1917 年的政党活动和宣传阶段、1917—1932 年的成熟和实践阶段,其主要观点形成于马克思主义在苏联(沙俄)的早期传播过程之中,又结合本土的法社会学和法律实践,对苏联国家与法的理论中建立马克思列宁主义的方法论和法律原则起到了重要作用。他作为法学家的法学和政治学世界观形成的每个阶段都对政治实践发挥了积极的影响,他的学说直至今日仍是俄罗斯国家与法的历史,乃至现代法律科学发展的重要影响因素之一。

【摘要】马克思主义法政治学的基本原理是马克思主义法治理论的基本原理与马克思主义政治理论的基本原理交叉融合的理论领域,后者主要包括马克思主义民主理论、国家学说和政党学说的基本原理。马克思主义法政治学的基本原理主张政治与法治具有“同源”“共振”“互动”三重逻辑。在习近平法治思想中,马克思主义法政治学的方法论贯穿其中,科学认识并正确处理政治与法治、治国与治党、民主与法治之间的重大辩证关系,是深入阐释习近平法治思想、持续推进全面依法治国的重要理论精髓,有利于推动习近平法治思想研究从“传统性”向“开放性”的跨学科转变,从“知识之维”向“实践之维”的应用性转变,引领中国特色社会主义法政治学体系研究实现“理论原理”与“方法论实践”的连接。

【摘要】本文提供了一种对马克思的历史理论和法律(以及道德)是“意识形态的”的主张的解释,然后追问何种理论足以解释马克思主义理论同时在意识形态和非意识形态意义上理解法律的方式。不同于其他的关于法律本质的理论,法律实证主义提供了一种以马克思主义的历史变革理论为目的的对法律的解释。后者反过来又提供我们另一个数据点,支持实证主义作为唯一严肃的对法律的概念的解释,因为它能够解释作为历史和社会科学中最重要的解释范式之一的法律的概念。

6、女性异化理论视域下辅助生殖技术的危害与法律规制

【摘要】作为综合女权主义核心主张和马克思主义异化劳动理论形成的新理论成果,女性异化理论为管窥辅助生殖技术给女性造成的危害提供了分析工具。表面上,女性接受辅助生殖手术是自愿的选择,但这种自愿实为传宗接代观念形塑而成的。进入辅助生殖程序后,在成功妊娠这一强烈目标的指引下,女性衍化为生殖医疗技术的试验场。在涉及代孕和卵子交易的场域中,资本逻辑的作用将女性定性为商品化的存在。男孩偏好指引下的基于性别的堕胎直接阻止的虽是女性胚胎的降生,但由此造成的否定性波及效应使其他女性无法独善其身,所有女性都难摆脱第二性的命运。为此,在贯彻社会性别主流化的基础上建构起完善的辅助生殖技术法律体系,是克服技术异化的负面效应、维护女性尊严的必然要求。

7、纯粹法学与马克思主义法学的法律科学“纯粹性”之辩

【摘要】尽管凯尔森的纯粹法理论在规范的形式 逻辑方面贡献卓著,但他以“纯粹性”为标尺对马克思主义法学理论的批判,不仅暴露了
自身理论的局限性,以及对客观性概念的认知分裂和偏差,更“反证”了马克思主义法学理论的真理性。在对凯尔森马克思主义法学理论批判的批判中,法律科学的宗旨和使命得以澄清:为保证研究对象和研究方法的“纯粹性”便切除所有“前规范”或“规范外”的事实与价值,剥离规范的实质内容,无疑是舍本逐末的错误。法律科学之所以为法律科学,首要的不在于其“纯粹性”,而在于它能通过认知法律现象,为改造法律实践提供理论资源。而法律科学的客观性追求也应当是建立在历史唯物主义基础上的、血肉丰满的客观性追求。

8、《论再生产》的法理论探究

【摘要】阿尔都塞的法理论是其上层建筑理论中重要但又常被忽视的理论。本文通过对于《论再生产》展开文本解读,以法与生产关系、国家机器、意识形态等诸要素之间相互关系作为主要问题,研究阿尔都塞是如何重绘马克思“经济基础-上层建筑”社会的二分结构,构建诸要素相互联系的法系统的。阿尔都塞的法理论对于反思资本主义法律关系,推进马克思主义法学研究有着重要意义。

【作者】弗兰茨·诺伊曼 著,(FranzNeumann,1900—1954),德国政治活动家、西方马克思主义(法兰克福学派)理论家、战后德国现代政治学的奠基人之一,以其对纳粹的理论分析而闻名。

【摘要】奥地利马克思主义者卡尔·伦纳等人的著作对德国马克思主义国家理论有重大影响。一战前社会民主党中的律师大多关注刑法改革,战后马克思主义理论与党的政策存在矛盾,导致年轻法学家的著作充满矛盾。赫尔曼·黑勒和哈罗德·拉斯基分别提出了不同的国家理论,黑勒认为国家独立于阶级结构,而拉斯基认为国家是阶级斗争的产物。马克思主义的国家理论是世俗和理性的,强调国家只是社会的功能,并不具有独立于社会之外的实质内容。黑勒试图将国家概念化为独立于阶级结构的单位,而拉斯基则支持马克思主义的国家观,认为国家是阶级斗争的产物。马克思主义政党在国家问题上的立场由战略考虑决定。

11、再生产视角下的当代父权制资本主义的批判
———评南希·弗雷泽《食人资本主义》

【摘要】南希·弗雷泽在《食人资本主义》中揭示了资本主义危机的多重性与内生性,再生产危机无疑只是其中的一个向度。关于危机的成因,弗雷泽揭示了资本主义借助廉价化、性别化“关怀”的战略,对再生产的依赖并破坏,并与传统马克思主义女性主义观点进行对话。历史层面,其从再生产角度对资本主义发展进行了分期考察,观点可以得到相应时期法律实践的确证。观念层面,弗雷泽对“边界”与“关怀”的关注在某种意义上也是对再生产和家务劳动等经典论题的回归和超越。在社会主义和女权主义饱受质疑的当下,弗雷泽重拾政治经济学批判武器,从再生产视角切入,以自食其尾的衔尾蛇隐喻对当代父权制与资本主义的结合进行了有力批判。

12、“新圈地运动”转向下生态社会主义的法律转型

【摘要】南希·弗雷泽在《食人资本主义》中提出,资本主义结构性危机的根源在于它不断吞噬其社会生成基础的自我终结倾向。这尤其体现资本主义在圈地运动转向“新圈地运动”发展的各个历史阶段中,不断通过控制债务工具与划界标准来吸收生态、民主政治以及再生产领域的价值资源。这不仅造成了生态、政治、经济与再生产领域的整体性危机,而且使得这种危机互相勾连、绵延不绝。基于这种认识,生态社会主义法律应对“新圈地运动”整体性危机,需要在财产法、社会法以及气候法等领域重新进行边界划定工作,承认市场之外生态资源的独立价值,实现民主参与制度设计的转型愿景。

13、迈向“自然回归”的环境治理
———评南希·弗雷泽《食人资本主义》

【摘要】南希·弗雷泽在《食人资本主义》一书中指出,当前人类所面临的生态矛盾是资本主义结构性危机,其根源在于资本主义对生态再生产等非经济条件的否认。资本主义依赖自然的物质供给,但同时又否认生态再生产成本并将自然视为可以无限自我补偿的原料来源,塑造了作为意识形态的自然概念。即便资本主义国家孕育出了国家监管自然的环境治理体制,在一定程度上缓和了人与自然间的张力,继任体制依然延续了资本积累的逻辑。基于上述反思,真正解决当下的环境危机需要治理体系向生态社会主义转型,实现人类社会体系中历史化自然的回归与环境治理领域人与自然二元本体论的弥合。

14、种族主义阴霾下的国际经济法

【摘要】南希·弗雷泽在《食人资本主义》中指出,种族主义是资本主义的结构性基础。在四个资本主义时段,资本积累以不同形式的剥削和掠夺进行种族压迫,而国际经济法的变迁与弗雷泽的观点互相印证。资本主义的种族视角批判促使当代国际经济法进行反思,首先需要从根本上理解国际经济法背后的种族主义认识论,西方传统经济理论排除了历史上固有的种族差异和结构性不公。黑人激进传统为治理资本主义提供了参考,但在实践中仍需要全球北方和南方形成跨种族联盟共同对抗危机。

(1)“ Volitionism” or “Passive–Determinism”? : AReinterpretation of the Core Views on Law by the Founding Fathers of Marxism

Abstract: The “dominant class volitionism” is not conduciveto the contemporary legal construction in China in practice since it does notalign with the original intention of the founding fathers of Marxism asexpounded in Manifesto of the Communist Party, and theoreticallycontradicts the logical framework of historical materialism. Adherence to theguidance of Marxist theory in the theoretical study of contemporary Chinese jurisprudencerequires a reinterpretation of the core views on law by the founding fathers ofMarxism in the sense of “passive–determinism”. This holds important theoreticalimplications for ensuring that contemporary Chinese legislation, policies, anddecrees conform to the requirements and rules of the market economy andsafeguard the normal development of social productive forces.

(2)Will of the Ruling Class or Social Relations? TheDebate on the Essence of Law in the Early Period of the Founding of the SovietUnion

Abstract: Marx and Engelsadvocated the ontology of social relations of law. The social relation ontologyof law was inherited and developed by Lenin, Stuchka and Pashukanis. The willtheory of the ruling class of law is a wrong interpretation of the Marxist theoryof the essence of law, argued by Vyshinsky, a Soviet jurist. In the earlyperiod of the founding of PRC, Chinese legal scholars accepted the Marxist viewof the essence of law interpreted by Wysinski, so the theory that law is thewill of the ruling class has always occupied a dominant position in Chineselegal circles. The will theory of the ruling class of law is not conducive tothe construction of the rule of law in China, we should adhere to and developthe ontology of social relations of law.

(3)The Formation and Basic Views on Stuchka’s Theoryof Law and Politics

Abstract: In the early days of the Soviet regime, juristsplayed an important role in the historical choices of the state and society,with P. I. Stuchka as an outstanding representative. According to Stuchka, thetheoretical basis of Marxism–Leninist interpretation of law lies in thefollowing three aspects: first, every law has its class characteristics;second, the revolutionary dialectics should be widely employed as methodology; and third, the relations in thematerial society are the basis for explaining and interpreting the idea ofjurisprudence as the superstructure. The development of Stuchka’s theory of lawand politics went through the formation stage from 1884 to 1888, the politicalparty activities and publicity stage from 1888 to 1917, and the maturity andpractice stage from 1917 to 1932. The main views of the theory, formed during the early dissemination ofMarxism in the Soviet Union (Tsarist Russia), and combined with indigenoussociology of law and legal practice, played an important role in theestablishment of Marxist–Leninist methodology and legal principles in thetheory of the Soviet state and law. Every stage of the formation of Stuchka’sworldview on law and politics has exerted a positive influence on politicalpractice and his theory remains one of the important factors which influencesthe history of state and law of Russia, and even the development of modernlegal science.

(4)An Elaboration on the Methodology of Marxist Politics of Law

Abstract:The basic principle of Marxist politics of law is the theoretical field that combines the basic principles of Marxisttheory of rule of law with the basic principles of Marxistpolitical theory, and the latter mainly includsthe basic principles of Marxist Democratic Theory, State Theory and Political Party Theory. The basic principle of Marxist politics oflaw holds the triple logic of “homology”, “synergy” and “interaction” betweenpolitics and the rule of law. Themethodology of Marxist politics oflaw is reflected in Xi Jinping thought on therule of law. We should correctly understand and balance the major dialectical relationship betweenpolitics and the rule of law, the governance ofthe state and the governance ofthe party, as well as democracyand the rule of law, which is the important theoretical essence for in–depthinterpretation of Xi Jinping thought on the rule of law and continuouspromotion of law–based governance in all fields. They are conductive to promoting theinterdisciplinary transformation of the study of Xi Jinping thought on the rule of law from “traditionalism” to “openness”, the appliedtransforomation from “knowledge” to “practice”, and leading the research on socialist politics of law system with Chinese characteristics to realize the connection of “theoretical principles” and “methodological practice”.

Abstract: This article provides an interpretation of Marx’stheory of history and his claim that law (and morality) are “ideological,” andthen explores the theory which is adequate to explain the way the Marxisttheory understands law in both ideological and non–ideological contexts. Legal positivism, unlike otherviews on the nature of law, provides a reasonable interpretation of law withthe aim of the Marxist theory of historical change. This latter, in turn,provides us with another data point in favor of positivism as the only seriousexplanation of the concept of law, as it can explain the concept of law as oneof the most important interpretive paradigms in history and social sciences.

(6) The Harm and Legal Regulation of Assisted Reproductive Technology fromthe Perspective of Female Alienation Theory

Abstract: As a new theoretical achievement formed bysynthesizing the core propositions of feminism and the Marxist theory ofalienated labor, female alienation theory provides an analytical tool for theharm caused by assisted reproductive technology to women. On the surface, women’s acceptance of assistedreproductive surgery is the result of voluntary choice, but this willingness isactually shaped by the concept of carrying on the family line. During the assisted reproduction procedure, guidedby the goal of a successful pregnancy, women are forced to become a testingground for reproductive medical technology. In the field involving surrogacy and egg trading,under the influence of the capital logic, women are characterized as acommodified beings. Although gender–based abortion due to male preferencedirectly prevents the birth of female embryos, the negative ripple effect makesit impossible for other women to be independent and immune, and it is difficultfor women to escape the fate of being the second sex. In view of this, theconstruction of a sound legal system of assisted reproductive technology on thebasis of gender mainstreaming is an inevitable requirement of overcoming thenegative effects of technological alienation and safeguarding the dignity ofwomen.

Abstract: Althusser’s theory of law is animportant but often overlooked one of his superstructure theories. Through thetextual interpretation of Sur la reproduction, this article takes theinterrelationship between law and relations of production, state apparatus,ideology and other elements as the main issues, and studies how Althusserredrew “economic basis and superstructure” dichotomous structure of society, andconstructed a legal system with all elements are interrelated. Althusser’stheory of law is of great significance in reflecting on capitalist legalrelations and promoting the study of Marxist law.

(8) Review of Two Recently Published Works on Theories of State

Abstract: The works of Austrian Marxists Karl Renner and others have had a greatinfluence on the German Marxist theory of the state. Before World War I, mostof the lawyers in the Social Democratic Party focused on penal reform, andafter the war, the contradiction between Marxist theory and party policy led tothe contradictory writings of young jurists. Hermann Heller and Harold Laskydeveloped different theories of the state, with Heller arguing that the stateis independent of the class structure, and Lasky arguing that the state is aproduct of the class struggle. The Marxist theory of the state is secular andrational, emphasizing that the state is only a function of society and has nomaterial content independent of society. Helle sought to conceptualize thestate as a unit independent of class structures, while Lasky supported theMarxist view of the state as a product of class struggle. The position ofMarxist parties on state issues is determined by strategic considerations.

(9)Summary of the academic seminar on "MarxistJurisprudence and Legal Theoretical Research in the New Era"
In-depth exploration of Marxist classics and further enriching anddeveloping the Marxist rule of law theoretical system are necessary tocomprehensively promote the rule of law. On November 25, 2023, the academicseminar "Research on Marxist Law and Legal Theory in the New Era" washeld in Xi'an. Scholars attending the meeting conducted in-depth discussions onthe legal thought of Marxist classics, the sinicization and modernization ofMarxist law, and the basic principles of Marxist law. Marxist jurisprudence isa practical jurisprudence with strong theoretical explanatory power. On November 25, 2023, the Academic Seminar onMarxist Jurisprudence and TheoreticalResearch on Law in the New Era and the First Special Seminar on The Journalon Marxism and Law, hosted by Northwest University of Political Science andLaw (NWUPL) and organized by the Institute of Advanced Studies in Law Science–Technologyand Humanities of NWUPL, the Higher Education Research Institute of NWUPL, andthe editorial department of The Journal of Marxism and Law of NWUPL, washeld in Xi’an. The conference set up the forum on Marxist Law for master degree and doctor degreecandidates, co–hosted by Professor Li Xiaohui from the Institute of ComparativeLaw at China University of Political Science and Law and Professor Yao Yuanfrom the Law School of Nanjing Normal University. More than twenty graduatestudents all over the country engaged in discussions on various topics. Amongthem, several graduate students provided different perspectives on ProfessorNancy Fraser’s book Cannibal Capitalism. This article is compiled fromconference papers and speeches. (11)A Critique of Contemporary Patriarchal Capitalismfrom a Reproductive Perspective – Review of Nancy Fraser's CannibalCapitalism

Abstract: In her book CannibalCapitalism, Nancy Fraser reveals multiplicity and endogeneity of capitalistcrises, of which the crisis of reproduction is undoubtedly one vector. As forthe causes of the crisis, Fraser reveals capitalism’s reliance as well asdestruction of reproduction through strategies of cheapened and genderized careand tries to engage in a dialogue with traditional Marxist feministperspectives. Historically, the development of capitalism is examined in termsof stages from the perspective of reproduction, and this viewpoint can beconfirmed by legal practice during the corresponding period. At the conceptuallevel, Fraser’s focus on “boundaries” and “care” is, in a sense, a return andtranscendence of classic issues like reproduction and household labor. At thetime when socialism and feminism are being challenged, Fraser regains thecritical weapon of political economy and, from the perspective of reproduction,makes a powerful critique of the combination of contemporary patriarchy andcapitalism through the metaphor of ouroboros eating their own tails.

Abstract: In Cannibal Capitalism,Nancy Frazer argues that the structural crisis of capitalism is attributed toits self–defeating tendency that constantly devours its survival basis. This isparticularly evident in capitalism’s continuous absorption of value resourcesfrom the ecological, democratic political and reproductivespheres through the control of debt instruments and boundary criteria in everyhistorical phase from the enclosure movement to the “neo–enclosuremovement”. This not only causes theoverall crisis of ecology, politics, economy and reproduction, but also makesthese crises interconnected and continuous. Therefore, it is necessary for theeco–socialist law to redefine the categories andfields in property law, social law and climate law, recognize the independentvalue of ecological resources outside the market, and guarantee thetransformation of public democratic participation in institutional design.

Abstract: In the book CannibalCapitalism, Nancy Fraser points out that the ecological contradictionshumanity faces today are parts of the structural crises of capitalism, rootedin capitalism’s denial of non–economic conditions such as ecologicalreproduction. Capitalism relies on the material supply from nature, but at thesame time denies the costs of ecological reproduction and treats nature as aninfinitely self–compensating source of raw materials, shaping it as anideological concept. Even though capitalist nations have developedenvironmental governance systems of regulation of nature by the state, which,to some extent has mitigated the tension between human beings and nature, thesuccession system still continues the logic of capital accumulation. Based onthe reflections above, to address the current environmental crisis requires thetransition of the governance system to ecological socialism, the realization ofthe return of historicized nature in the human social system and the bridgingof the dualistic ontology of humans and nature in the field of environmentalgovernance.

Abstract: In her book CannibalCapitalism, Nancy Fraser points out that racism is the structuralfoundation of capitalism. Throughout four distinct periods of capitalism,capital accumulation has facilitated racial oppression through various forms ofexploitation and expropriation, which is corroborated by the evolution ofinternational economic law. The critique of racial perspectives on capitalismprompts a reevaluation of contemporary international economic law. It isnecessary to fully and deeply understand the racist epistemology behindinternational economic law,. Traditional Western economic theory excludesinherent racial differences and structural injustices in history. The blackradical tradition provides a reference for the governance of capitalism, but inpractice it still requires the North and South to form a cross–racial allianceto jointly confront the crisis.
